As you all aware, RJCM is the highest body for discussing our issues with the Circle Administration and only our Association can participate in the RJCM in r/o our SBCO cadre. The Subjects in r/o our SBCO cadre for discussion in the RJCM meeting to be held during Aug 2015 are given below.
1.
Stop recovery of amount of
loss in SB from Subsidiary offenders in
fraud cases :
1.1 It is
requested to take necessary action to recover the amount defrauded from the
Prime offender only as far as the offender is alive and sane.
1.2 Para 2.1
of DG post letter no. 4-66/TN-16/2009-INV dated 19.03.2015 clearly indicates
the action to be taken which is reproduced below.
“PAD act 1850 which stipulates that all movable and
immovable properties of the persons who collect money for depositing with Govt.
and their family members be identified through Departmental sources and
intimated to Revenue authorities to stop their alienation and recovery of loss.
Above definition of persons collecting money from Public for depositing money
with Govt encompasses both Postal
employees and Agents. As such PAD
act 1850 is also applicable to Agents as well as Prime offenders / Co
offenders.”
1.3 Without taking such efforts to recover the amount
from Prime/Co- offenders and in some cases from the Agents who collect money
from Public for deposit in Govt., ordering recovery from the officials showcasing
as Subsidiary offenders is against the very principle of Natural justice. In
almost all the fraud cases, at the initial time itself, orders are issued to
recover the amount from Subsidiary offenders and recovery started from their
salary.
1.4 Hence
specific orders may be issued to recover the defrauded amount from the
officials / persons who actually involved and gained money from the fraud and cause issue of
necessary orders to stop recovery from the officials identified as Subsidiary
offenders in the existing cases immediately.
2.Provision of Record room
to SBCO Units :
2.1 SBCO is
responsible to keep in its safe custody important records vide Rule 4 and to
preserve them up to specified period as mentioned in Rule 25 of SB control
Procedure. To preserve the records, Record room with sufficient space and steel
almirahs with lock and key should be provided vide rules. Only if this
requirement is fulfilled, all the
records may be arranged in a systematic manner and in case of any fraud, records required for investigation purpose
will be retrieved early and handed over to Administration.
2.2 Hence ,
suitable orders may be issued in this regard and guidelines may be issued to
Divisional Administration / Gazetted Post masters to comply with the provisions
in Rule 25 of SB control Procedure.
3.
Review of Computer systems available in SBCO units :
The SBCO branches were equipped with
computers during 1995/96 and
most of the SBCO units are still functioning with the very old computer systems
in foxpro based programme. It is requested to conduct an
over all assessment of the functioning/ contamination of the Computer systems and
replace with new systems
